ESCAPE TO THE MALDIVES COMPETITION — TERMS AND CONDITIONS
- PROMOTER AND PROMOTION PERIOD
1.1 The promoter of this competition is Luxury Escapes Travel Pty Ltd (ABN 16 150 650 927) of Level 4, 68 Clarke Street, Southbank, Victoria 3006 (the “Promoter” or “Luxury Escapes”).
1.2 PassportCard Australia Pty Ltd (ABN 76 621 476 220) (“PassportCard”) is a promotional partner and prize supplier. PassportCard is not the promoter of, and does not conduct, this competition.
1.3 The competition opens at 12:00pm AEST on 21 August 2026 and closes at 11:59pm AEST on 4 September 2026 (the “Promotion Period”). Entries received outside the Promotion Period are invalid.
1.4 The competition is promoted across the Promoter’s social media channels, with a link directing entrants to the entry page at passport-card-competition (the “Entry Site”).
- ACCEPTANCE
2.1 Entry into the competition is deemed acceptance of these terms, which incorporate the Luxury Escapes Privacy Policy and Website Terms of Use.
- PROMOTIONAL AUTHORITY
3.1 This competition is a game of skill. Chance plays no part in determining the winner. Every valid entry is individually judged against the judging criteria in clause 6. No trade promotion permit or licence is required in any Australian jurisdiction.
- ELIGIBILITY
4.1 Entry is open to natural persons who are residents of Australia and aged eighteen (18) years or over at the time of entry.
4.2 The following persons are ineligible to enter:
(a) employees, contractors and officers of the Promoter, PassportCard, and their related bodies corporate;
(b) agencies and companies directly involved in the conduct of this competition; and
(c) immediate family members of any person in paragraphs (a) or (b).
4.3 Entry is free. No purchase is necessary.
4.4 Limit of one (1) entry per person. Where a person submits more than one entry, only the first valid entry received will be judged and all later entries will be invalid.
- HOW TO ENTER
5.1 To enter, an eligible entrant must, during the Promotion Period, visit the Entry Site, provide their full name, valid email address and state or territory of residence, submit an original written response of twenty-five (25) words or fewer to the question “Tell us in 25 words or less who you would take on this Luxury Escape and why?”, and accept these terms.
5.2 Entries that are incomplete, late, indecipherable, offensive, defamatory, unlawful, or that infringe a third party’s rights, are invalid. The Promoter is not responsible for entries that are lost, delayed, corrupted or misdirected, or for technical failures outside its reasonable control.
5.3 Entries must be the entrant’s own original work. Entries generated by automated means, or submitted through multiple accounts, by third parties or by collusion, are invalid, and the Promoter may disqualify any entrant it reasonably suspects of such conduct.
- JUDGING AND WINNER SELECTION
6.1 This competition is a game of skill. Chance plays no part in determining the winner.
6.2 Judging will take place at 12:00pm AEST on 8 September 2026 at Level 4, 68 Clarke Street, Southbank, Victoria 3006, by a panel of three (3) judges appointed by the Promoter.
6.3 Each valid entry will be scored against the following criteria:
(a) creativity (40%);
(b) originality (30%); and
(c) emotional resonance and connection to the prize experience (30%).
6.4 The entry with the highest total score will be selected as the winner. Where two or more entries receive the same score, the tied entries will be re-judged by the panel against the same criteria until a single highest scoring entry is identified. No tie will be resolved by chance.
6.5 The judges’ decision is final, and no correspondence will be entered into, subject to the entrant’s non-excludable rights under Schedule 2 to the Competition and Consumer Act 2010 (Cth) (the “Australian Consumer Law”).
- PRIZE
7.1 There is one (1) prize. The winner receives:
(a) a five (5) night ‘all-inclusive’ stay for two (2) people at Noku Maldives in a King Villa Ocean View Overwater Villa, comprising return seaplane transfers between Malé and the resort, all daily meals, unlimited select drinks and a daily replenished in-villa minibar, one (1) private beach dinner and one (1) sunset cruise experience per person, and complimentary non-motorised water sports, in each case as described in the package inclusions published on the Entry Site and subject to clauses 7.4 to 7.6;
(b) two (2) return economy class flights from Melbourne, Australia to Malé, Maldives, subject to availability and the airline’s booking conditions; and
(c) PassportCard travel insurance for the winner only, on the terms set out in clause 8.
7.2 Flights depart from and return to Melbourne only. Travel between the winner’s home and Melbourne, including any domestic connecting flights, accommodation and transfers, is not included and is the responsibility of the winner and the person nominated by the winner to travel with them under clause 9.3 (the “companion”).
7.3 The total prize value is approximately AUD $17,000 including GST as at 14 August 2026, based on the recommended retail value of the package and the lead-in economy fare at that date. Actual value varies with the travel dates selected and availability, and no compensation is payable if it is less. The stated value does not include the charges payable by the winner under clauses 7.5 and 7.6, or any other cost referred to in clause 9.5.
7.4 The accommodation and dining components are as described in the package inclusions published on the Entry Site. Dining inclusions do not include drinks unless expressly stated, menus may change without notice, advance reservation is required for the private beach dinner and the sunset cruise, and free-flow drinks are limited to the resort’s select all-inclusive menu.
7.5 The following charges are not included in the prize and are payable by the winner directly to the resort:
(a) a green tax of US$12 per person, per night, excluding infants;
(b) for stays on 24 December, a compulsory Christmas Gala dinner surcharge of US$300 per person; and
(c) for stays on 31 December, a compulsory New Year’s Eve Gala dinner surcharge of US$600 per person.
7.6 A non-refundable surcharge per room, per night may apply to travel on certain dates and is payable by the winner at the time of booking. Applicable dates and amounts are identified in the resort’s booking calendar. Blackout dates may apply.
7.7 Seaplane transfers between Velana International Airport, Malé and the resort operate during daylight hours only. Inbound flights must arrive before 1.00pm and the last seaplane departure is 3.30pm; where flights fall outside these times, an overnight stay near the airport may be required at the winner’s own expense. Flight details and passport names must be provided at least seven (7) days before arrival. Transfers are operated by a third party and are subject to weather, tides, airline policies and the operator’s baggage allowances and charges.
7.8 Images used in promotional material for this competition are for illustrative purposes and may not reflect the package awarded as the prize.
7.9 The prize is subject to the resort’s and the relevant suppliers’ own terms and conditions, which apply in addition to these terms. Package inclusions and fine print are accurate at the date of publication, and the winner should check the fine print published on the Entry Site before departure.
- TRAVEL INSURANCE
8.1 The prize includes a PassportCard travel insurance policy covering only the travel arrangements forming part of the prize. The policy is a single trip international travel insurance policy on the cover level and sum insured notified to the winner when the policy is arranged, and no particular level of cover, benefit limit or sum insured is promised as part of the prize.
8.2 The winner must contact PassportCard to arrange the included policy before departure. The Promoter is not able to arrange the policy on the winner’s behalf.
8.3 The policy is issued by PassportCard Australia Pty Ltd ABN 76 621 476 220, AFSL 551057 being an underwriting agency acting under a binding authority from the insurer, Guild Insurance Ltd, ABN 55 004 538 863, AFSL 233791 and is subject to that issuer’s policy terms, conditions, exclusions, limits and eligibility criteria, including any age limits and exclusions for pre-existing medical conditions. Cover is not guaranteed. Entrants should read the Financial Services Guide and Product Disclosure Statement and the Target Market Determination before relying on this component of the prize.
8.4 The Promoter does not provide financial product advice. Nothing in these terms or in any promotional material is a recommendation that the policy is suitable for any person. Any decision about insurance cover is a matter for the winner.
8.5 If the winner is not eligible for cover, or declines cover, no cash or alternative benefit is payable in place of that component of the prize.
8.6 Any additional travel, stopovers, itinerary changes, extensions, or arrangements made outside the prize package are not covered by the included policy and are at the winner’s own expense. The winner is responsible for arranging any additional insurance the winner considers necessary. The winner’s companion is not covered by the included policy and is responsible for arranging their own travel insurance at their own expense.
- PRIZE CONDITIONS
9.1 The prize must be accepted within twenty-eight (28) days of notification.
9.2 Travel must be booked through Luxury Escapes or its nominated agent by 22 November 2027, and must be completed within twelve (12) months of winner notification and in any event by 22 December 2027. The prize is subject to availability, blackout dates, and resort and airline booking conditions.
9.3 The winner must nominate one (1) companion aged eighteen (18) years or over to travel with the winner. The companion must travel on the same itinerary at the same time as the winner. The companion is responsible for their own passport, visa, health requirements and compliance with these terms.
9.4 The winner and the companion are responsible for obtaining valid passports, visas, entry permissions and vaccinations, and for complying with all applicable travel requirements. Failure to do so does not entitle the winner to any alternative prize, extension or compensation.
9.5 All costs not expressly included in clause 7.1 are the responsibility of the winner and the companion and will not be reimbursed, including transfers within Australia, excess baggage, meals and beverages outside the stated inclusions, spa and activity charges, gratuities, charges payable locally, and all other personal expenses.
9.6 The prize is not transferable, not exchangeable, and not redeemable for cash, except where required by law.
9.7 If the prize or any component of the prize becomes unavailable for reasons outside the Promoter’s reasonable control, the Promoter may substitute that component with a component of equal or greater value, subject to any applicable regulatory direction and to the winner’s rights under the Australian Consumer Law.
9.9 The winner is responsible for any tax consequences arising from acceptance, use or realisation of the prize. The Promoter does not provide taxation advice, makes no representation as to the tax treatment of the prize, and will not reimburse the winner for any tax liability. The winner should obtain independent advice about their own circumstances.
- WINNER NOTIFICATION AND UNCLAIMED PRIZE
10.1 The winner will be notified by email within seven (7) days of the judging date, using the email address provided at entry.
10.2 The winner’s first name and state or territory of residence will be published on the Entry Site within twenty-eight (28) days of the judging date.
10.3 The Promoter may require the winner to provide proof of identity, age, residency and eligibility before the prize is awarded.
10.4 If the winner cannot be contacted, does not respond within twenty-eight (28) days of notification, declines the prize, or is found to be ineligible, the prize is forfeited and the Promoter will award the prize to the entrant whose entry received the next highest score under clause 6. That entrant will be notified by email within seven (7) days. No redraw will be conducted, because this competition is a game of skill.
- INTELLECTUAL PROPERTY AND PUBLICITY
11.1 Each entrant grants the Promoter a non-exclusive, royalty-free, worldwide licence to use, reproduce, adapt and publish their entry for the purposes of conducting, promoting and reporting on this competition and the Promoter’s business, in any media, for twenty-four (24) months from the close of the Promotion Period, and warrants that the entry is their own original work and does not infringe any third party’s rights.
11.3 The winner agrees to participate in reasonable publicity relating to the prize, including the use of their first name, state or territory, and any images or content they voluntarily provide. The winner is not required to participate in publicity as a condition of receiving the prize.
11.4 To the extent permitted by law, each entrant consents to the Promoter and its licensees doing, or omitting to do, any act in relation to their entry that would otherwise infringe the entrant’s moral rights under the Copyright Act 1968 (Cth), including using the entry without attribution to the entrant, editing, adapting, abridging or adding to the entry, and using the entry in association with the Promoter’s business, brands and other material. Each entrant gives this consent genuinely and voluntarily, and not as a result of any false or misleading statement or any duress.
- SOCIAL MEDIA PLATFORMS
12.1 This competition is in no way sponsored, endorsed, administered by, or associated with Meta Platforms, Inc., TikTok, or any other social media platform. Entrants release each platform from all liability in connection with this competition. Any questions or complaints must be directed to the Promoter and not to the platform.
- PRIVACY AND DATA
13.1 Personal information collected on entry is collected by the Promoter and handled in accordance with the Privacy Act 1988 (Cth), the Spam Act 2003 (Cth), and the Luxury Escapes Privacy Policy.
13.2 Personal information is collected to administer the competition, verify eligibility, judge entries, notify and publicise the winner, and fulfil the prize.
13.3 Personal information may be disclosed to the Promoter’s service providers, to airlines, accommodation providers and other travel suppliers for the purpose of fulfilling the prize, and to regulators where required by law.
13.4 The personal information of the winner will be disclosed to PassportCard for the sole purpose of arranging the included travel insurance policy. PassportCard will handle that information in accordance with its own privacy policy. The personal information of entrants who are not the winner will not be disclosed to PassportCard except where the entrant has separately consented.
13.5 Where an entrant consents, the Promoter may send marketing communications by email, SMS and other electronic means. Consent to receive marketing communications is optional and is not a condition of entry, and an entry will not be treated as invalid or judged differently because consent is not given. Entrants may withdraw consent at any time using the unsubscribe facility in any marketing communication or by contacting the Promoter under clause 15.
13.6 Personal information of the winner and the winner’s companion is likely to be disclosed to recipients located outside Australia for the purpose of fulfilling the prize. Those recipients are likely to include the resort, Noku Maldives, which is owned and operated by IHG Hotels & Resorts and whose privacy statement is available on the IHG website, the seaplane transfer operator, and the airline or airlines carrying the winner and the companion, which may include Maldivian Airlines. Those recipients are located in the Republic of Maldives and in any other country in or through which the booked itinerary operates. The Promoter will take such steps as are reasonable in the circumstances to ensure that overseas recipients handle personal information in a manner consistent with the Australian Privacy Principles.
- LIABILITY, FORCE MAJEURE AND GENERAL CONDITIONS
14.1 The Promoter may verify entries and disqualify any entrant who tampers with the entry process, provides false information, or breaches these terms.
14.2 If an event outside the Promoter’s reasonable control occurs (including technical failure, fraud, tampering, cyber-attack, industrial action, pandemic, government or regulatory restriction, border closure, natural disaster, war, terrorism or civil unrest), the Promoter may modify, suspend, terminate or cancel the competition, subject to any applicable regulatory direction. Any such change will be notified on the Entry Site and will not retrospectively disadvantage entries already validly submitted.
14.4 To the maximum extent permitted by law, the Promoter is not liable for any loss, damage, injury or liability arising from participation in this competition or from the acceptance, use or misuse of the prize, including any act, omission or failure of any third-party supplier such as an airline, accommodation provider, transport operator or insurer.
14.5 Nothing in these terms excludes, restricts or modifies any liability for death or personal injury caused by negligence, any liability for fraud, or any right or remedy that cannot be excluded under the Australian Consumer Law or the Competition and Consumer Act 2010 (Cth).
14.6 Entries from persons who are not eligible under clause 4 are void.
14.8 If any provision of these terms is invalid, illegal or unenforceable, it is severed to the extent necessary, and the remainder continues in full force.
14.9 These terms are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria.
